Terms and Conditions
These terms and conditions are building the business relation between Steinfels Hard- & Software, Frederic Steinfels, Neuwiesenstrasse 6, 8610 Uster, called SHS and the customer. Different agreements will have to be placed in the order comment and can lead to higher product prices or the refusal of the order.
Customer circle
SHS is delivering world wide. For exports, you do not have to pay the swiss VAT but you have to pay you own VAT and import tax. It is the customers responsiblity to calculate tax and vat before ordering from us.
Reserved rights and contract closure
The products offered on our web site are not binding. Every customer order is being checked manually and either accepted ("Dealer agreed to the order" in the order history) resulting in a sales contract or canceled.
The cusotmer's cancellation right
The only way to cancel a sales contract is this: Please send us an email containing your arguments why you want to cancel. This email will be processed by us and either confirmed or refused. Cancellations and information about them exchanged on different ways of communication groundless. Up to the time of cancellation, the sales contract is still valid no matter wheter the goods are paid or delivered. The cancellation is only valid if confirmed by us. Cancellations initiated by customers are always considered on a per product base. This might result in partial deliveries (further below). Cancellations will be accepted:
- If the delivery date is unknown and if the merchandise is not on the way to us already
- If there is a forseeable or already occured delay of one month or more to the initially given delivery date and if the merchandise is not on the way to us already
- In hard cases, we offer a delay tolerance of two weeks instead of one month against credit note but only if the merchandise is not on the way to us already
Important: A delivery date in the future does not mean that the goods are not already on the way to us. Delivery dates can always be wrong. We can not stress enough: A cancellation is only valid if and when confirmed by us by email and under no circumstance when initiating the cancellation. SHS's cancellation right
- If we can forsee that we can not deliver the product that was offered by a specific supplier at a certain price in a time period acceptable to our customer.
- Obvious errors. This applies to product prices more than 15% cheaper than the cheapest comparable offer available in Switzerland.
- If we think the order might be fraud.
Refusals, returns, refusing to pay
SHS is only accepting the returning of modification kits if it is not possible to get them to work in the target device. All other products are not returnable anyway. Nevertheless if we should accept the returning of a product or if a product was refused by the customer, SHS is charging the whole freight, 20% handling, devaluation from price reductions or scratches etc or incomplete deliveries. Furthermore SHS can charge the customer for all costs caused by our suppliers charging us for taking back the goods.
Partial Deliveries
SHS reserves the right for partial deliveries. Partial deliveries are possible on the customers request; additional freight will be charged.
Freight
The customer has to cover any freight, even for transport damage (will be refunded later on, see below), warranty (see below) and repairs. Partial delivery is possible on request. The return transport for erraneous deliveries is covered by us. The freight and shipping method guessed when accepting the contract can be changed and corrected by both parties if required or desired.[/d]
Warranty for products manufactured by us
- SHS is providing one year full warranty on products manufactured by us.
- During a time period of one year, SHS is ensuring the manufacturer warranty applies on products sold and modified by us by removing the modification, sending in the merchandise and reapplying the modification.
- SHS is providing one week of warranty on products modified by us.
- SHS is providing a live long warranty on the software of products made by us.
Warranty for merchandise
SHS is forwarding the warranty of the importeur or manufacturer (usually one year). SHS does not provide it's own warranty. The terms and conditions of the corresponding supplier do apply.
Warranty Location
Warranty location is the repair station in switzerland given by us (bring-in warranty = the freight and risk from and to this location is covered by the customer). For a fee of CHF 20 plus freight we can do the warranty handling for the customer. Unfortunately some supplier do require us to handle the warranty.
Warranty Limitations and Expansions
The warranty can be limited by the importer (for example for wear and expandablle material). Additional warranty offered by the importer or manufacturer is in his own responsiblity.
Packaging for Returns, Warranty or Repairs
Damage, repackaging and additional cost (for example special transports) caused by the lack of the original packaging or sufficient overpackaging (if required), have to be paid by the customer.
Transport losses and damages
For charged shipments of products with sufficient or original packaging either sold or modified by SHS on the way from SHS to the customer within Switzerland, the transport insurance of SHS is paying the damage. For shipments to foreign countries, the customer has to carry the risk. In order to claim a transport loss or damage, please have your claim signed by the carrier if possible. We do need the claim within three working days.
Repair Time and Exchanges
Repair delay can be up to three months. After three failed repair attempts, the customer will get a replacement. Usually it takes one to three weeks to repair goods from a swiss supplier. If ordered from "German distributor", it usually takes one month.
Support & Installations
Products manufactured by SHS: SHS is providing the usual support.
Consumer electronics: Service, support, handling, installation, product information and help of any kind is charged at CHF 150 net per hour. Driving time is working time but there is no additional charge for the way. If handcraft is required, one additional working hour is charged for the tools and preparation.
If the customer is asking for paperwork available in our web shop / web site, we can charge CHF 10 for it.
Liability
SHS is only liable for direct damages at culpable negligence with a maximum of the product price.
Court jurisdiction and law
Swiss law does apply to all our contracts. Court jurisdiction is Uster. SHS can file a lawsuit at the customer's court jurisdiction.
Payment methods
Customers not having enough money to pay immediately or not being 18 years old, are allowed to order by 'money in advance' only. The parents will have to accept the order.
We do reserve the right to change the payment method without invalidating the sales contract. The pament methods invoice and credit card are granted only if the customer is not in debt, the adress can be validated or it is a reoccuring customer.
Until the goods are fully paid they remain in the property of SHS. Without further agreement, payment is due within ten days.
SHS might request a written authorisation for credit card orders. On merchandise (all products not from the Modification category) a 5% surcharge applies on payment methods that are risky for us (credit card, invoice). If you want to want to pay by credit card, you will be asked to reserve the order total on your card in our web shop. Your card will not be charged before shipping the goods.
Currency exchange risk, transfer fees, import duties, import taxes (vat) and duties have to be covered by the customer.
SHS can back order or reserve the merchandise for the customer when finalizing the contract or when receiving the payment.
Payment reminders
We do send payment reminders by email every five days. It is the customers responsibility to receive and read them. After about 10 days of grace time we might charge a fee of CHF 30 and will forward the debt to Allinkasso Services. The customer agrees to pay at least 10% or CHF 30 whatever is highder as their fee.
Refunds
Refunds are made within 1 to 3 days after a refund request has been placed on our website in your order in the pink savings pig section. Refund requests through other means of communication are disregarded. The customer will be informed by email that money is being refunded after us having processed his refund request. In rare exceptions (Illness, Accident, Holidays) it can take up to four weeks. For refund requests with wrong or incomplete information the "refund request" checkmark will be cleared without notification and a corrected request has to be placed by the customer. Refund requests are disregarded if they are placed on receipts containing no credit note. It might be necessary to ask for a cancellation first. If no refund is requested, the credited amount of money can be used for further purchases as long as SHS is in this business.
Privacy plicy
We do protect our customer data as good as we can. We do not store credit card numbers in our data base; therefore they have to be entered on every order. We do not give out any personal information to third parties. Web content is encrypted whenever necessary or useful. Unfortunately personal data sent in emails can not be protected. SHS reserves the right to give away personal information if the customer is trying to cheat or is cheating, suppling falsified information or breaking the contract.
Final clause
If one of the terms should be invalid, the other terms remain valid. The invalid term will be replaced with a term having the closest possible intention of the author.
